1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FlySivana Travel LLC ("FlySivana," "we," "our," or "us"), a limited liability company organized under the laws of the State of Nevada, with its principal office at 701 S Carson St, Suite 200, Carson City, NV 89701, USA. By accessing or using the FlySivana website at flysivana.com (the "Site") or any travel booking services offered through the Site (the "Services"), you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Site or Services.

2. Eligibility

The Site and Services are intended for use by individuals who are at least eighteen (18) years of age and who have the legal capacity to enter into binding agreements. By using the Site, you represent and warrant that you meet these eligibility requirements. If you are using the Site on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Description of Services

FlySivana operates as a travel services company that connects travelers with flight fares, vacation packages, and related travel products. We source fares through airline consolidator networks and partner with hotels, tour operators, and ground transport providers to assemble vacation packages. FlySivana acts as an intermediary between you and the ultimate travel service providers (airlines, hotels, tour companies). We are not the operator of any flights, accommodations, or tours booked through our Services.

Our Services include, but are not limited to, displaying available flight fares, vacation packages, and last-minute deals; accepting booking requests through online forms; providing fare quotes and booking confirmations; and offering customer support before, during, and after your travel dates.

4. Booking Process

Bookings through FlySivana follow a request-and-confirm process. When you submit a booking request through the Site, you are expressing interest in a specific fare or package. Submission of a request does not constitute a confirmed booking or a binding purchase agreement. A binding booking is only created when FlySivana sends you a written booking confirmation and you complete the associated payment.

Fare quotes provided in response to your request are valid for a limited time as specified in the quote. Fares are subject to availability and may change between the time of your request and the time of confirmation. FlySivana makes reasonable efforts to ensure pricing accuracy on the Site, but we do not guarantee that all displayed prices will be available at the time of booking.

5. Pricing and Payments

All prices displayed on the Site are in United States Dollars (USD) and include applicable taxes and mandatory carrier fees unless otherwise noted. Optional add-on services such as checked baggage, seat selection, travel insurance, and airport transfers are priced separately and clearly itemized in your booking quote.

Payment is due upon confirmation of your booking unless a payment plan has been agreed upon. FlySivana accepts Visa, Mastercard, American Express, Discover, and PayPal. Payment processing is handled by third-party providers that comply with PCI-DSS standards. FlySivana does not store complete credit card numbers on its servers.

For vacation packages and bookings totaling eight hundred dollars ($800) or more, FlySivana may offer installment payment plans at its discretion. Payment plan terms, including installment amounts and due dates, will be specified in your booking confirmation. Failure to complete scheduled payments may result in cancellation of your booking.

6. Cancellations and Refunds

Cancellation terms depend on the fare class, the specific airline or hotel partner, and the type of booking (flight only, vacation package, or last-minute deal). General cancellation guidelines by fare class are published on our Booking Info page and in each booking confirmation.

To request a cancellation, contact FlySivana at [email protected] or call +1 (775) 461-8234 during business hours. Provide your booking confirmation number and the reason for cancellation. Our team will review the applicable policies and inform you of any refund eligibility, cancellation fees, or travel credit options.

Refunds, where applicable, are processed within seven (7) to fourteen (14) business days. The method of refund corresponds to the original payment method. Travel credits, where issued, are valid for twelve (12) months from the date of issuance and may be applied to any future FlySivana booking. FlySivana is not responsible for refund delays caused by your bank or payment provider.

7. Travel Documentation and Requirements

You are solely responsible for obtaining and maintaining valid travel documentation, including but not limited to passports, visas, health certificates, and any documentation required by the destination country or transit countries. FlySivana provides general guidance on travel documentation requirements but does not guarantee the accuracy or completeness of such guidance. You should independently verify all entry requirements with the relevant consular authorities before your departure.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FlySivana Travel LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Site or Services, even if FlySivana has been advised of the possibility of such damages.

FlySivana's total aggregate liability to you for any claims arising out of or related to these Terms or your use of the Site and Services shall not exceed the total amount you paid to FlySivana for the specific booking that is the subject of the claim. This limitation applies regardless of the legal theory on which the claim is based, whether contract, tort, strict liability, or otherwise.

FlySivana is not liable for the acts, omissions, delays, or failures of any third-party service provider, including airlines, hotels, tour operators, ground transport companies, or payment processors. Flight delays, cancellations, overbookings, lost baggage, and other travel disruptions are the responsibility of the applicable airline or service provider.

9. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. FlySivana disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

While FlySivana makes reasonable efforts to verify fare availability and pricing accuracy, we do not guarantee that all information displayed on the Site is current, complete, or error-free. Prices, availability, and travel schedules are subject to change without notice.

10. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, data compilations, and software, is the property of FlySivana Travel LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The FlySivana name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FlySivana Travel LLC.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent, except for temporary caching or printing of individual pages for personal, non-commercial use.

11. User Conduct

When using the Site and Services, you agree not to:

• Provide false, inaccurate, or misleading information in any booking request or form submission
• Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems or networks connected to the Site
• Use automated systems, bots, or scripts to access, scrape, or interact with the Site
• Interfere with or disrupt the operation of the Site or the servers and networks used to make the Site available
• Impersonate any person or entity or falsely represent your affiliation with any person or entity

12. Indemnification

You agree to indemnify, defend, and hold harmless FlySivana Travel LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including any intellectual property, privacy, or publicity right; or (d) any content or information you submit through the Site.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site or Services shall be brought exclusively in the state or federal courts located in Carson City, Nevada. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

14. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Carson City, Nevada, and the arbitrator's decision shall be final and binding.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

15. Modifications to Terms

FlySivana reserves the right to revise these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site and Services after the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically to stay informed about the conditions governing your use of our Services.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and any booking confirmations or supplemental agreements issued by FlySivana, constitute the entire agreement between you and FlySivana Travel LLC regarding the use of the Site and Services. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and FlySivana regarding the subject matter hereof.
